Below are the Terms of Use and Disclaimer of the online platform service (www.hybrid-plattform.org) whose operator is the Hybrid Plattform. The Hybrid Plattform is a joint pilot project of the Berlin University of the Arts and the Technische Universität Berlin in the framework of the Campus Charlottenburg.

Subject of Data Privacy
Data privacy covers personal data. According to art. 4 par. 1 of DSGVO this are data referring to an identified or identifiable individual, hence all data which could be used to identify you. This applies for data such as name, private address, e-mail address, telephone number but also to usage data such as your IP address.

Of course Hybrid Plattform observes the legal requirements of data privacy and other applicable regulations.

We are committed to ensure that you can trust us concerning your personal data. Therefore transfers of personal or sensitive data are encrypted.  In addition our websites are protected against damage and unauthorised access by technical measures.

Copyright and Trademark Law for Editorial Content
The Hybrid Plattform endeavors with all published material to observe copyrights of the images, graphics, audio and video documents, and texts used on the Website, to use original images, graphics, audio and video documents, and texts created expressly for and by the Website, and to use copyright-free photos, graphics, audio and video documents, and texts. All brands and trademarks named on the Website, which may be protected by third parties, are unconditionally subject to the regulations applicable under the respective trademark law and the ownership rights of the respective registered owners. The copyright for any material created by the Hybrid Plattform remains solely with the Hybrid Plattform and its authors. Duplication, processing, storage or use of such images, graphics, audio and video documents, and texts in other electronic or printed publications is not permitted without the express consent of the Hybrid Plattform and the content authors. This does not affect copying and downloading content for private, scientific and noncommercial use. Extent of Data Collection and Storage
For the usage of our websites the registration of your personal data is not necessary in general. For Hybrid Plattform to fulfil requested services, we require personal data in some cases. This applies especially for the individual replying to e-mails, provision of special services or applications. 

     1. Description and Extent of the Dataprocessing
If you entrust us with the supply of a service, we will only register and store your personal data as required for the supply of the service. In this case, your Data will be processed and stored with the help of the extern, online-based projectmanagement-serveice ‚Podio‘.

     2. Objection and Deletion of Data
You always have the option to revoke your consent for the processing of personal data. This objection must be done in writing or via email. All personal Data, which have been processed during the time of contact will be deleted.

Collection and Storage of Usage Data
For the optimisation of our websites we collect and store data, such as visited website, date and time of access, the website which you are coming from and so on.

For this purpose, we use Matomo (formerly known as Piwik, ref. www.matomo.org) in order to anonymously collect web statistics, based on the qualified interest of Hybrid Plattform, used for optimization and marketing purposes according to Art. 6 Par. 1 lit. f DSGVO. Your data will be anonymized directly after visiting a website. Due to a unique cookie accesses can be assigned to a person without being able to identify that person. Aside of accessed websites and files we additionally save for example your OS, browser, browser plugins (e.g. "Is the flashplayer available?"), screen resolution, your approximate location (e.g. "Berlin", but not your concrete address) and the duration of your visit.

Data Collection from the Use of Matomo (formerly called Piwik)
This website uses the open source web analysis service Matomo. Matomo uses so-called “cookies,” which are text files that are stored on your computer and that make it possible to analyse your use of this website. In conjunction with this, the information about the use of this website generated by the cookie will be archived on our server. Prior to archiving, the IP address will first be anonymized.

Matomo cookies will remain on your device until you delete them.

The storage of Matomo cookies and the use of this analysis tool are based on Art. 6 Sect. 1 lit. f GDPR. The website operator has a legitimate interest in the analysis of user patterns, in order to optimize the operator’s web offerings and advertising.

The information generated by cookies concerning the use of this website shall not be shared with any third parties. You may prevent the storage of cookies at any time by making pertinent changes to your browser software settings; however, we have to point out that in this case you may not be able to use all of the functions of this website to their fullest extent.

Data Usage for a Specific Purpose
We collect, process and store your personal data exclusively Hybrid Plattform internal for the purpose you notified us about and thereby we follow the principle of purpose related data usage. Without your explicit consent your personal data will not be given to third parties as long as it is not necessary for the supply of a service or execution of an agreement.  The forwarding of data to requesting governmental institutions and authorities is only conducted based on legal regulations resp. if we legally obligated by a judicial decision.

We take university internal data privacy very seriously. Our employees are bound to discretion and the compliance with data privacy laws by contract.

Cookies
Our website makes use of so-called cookies in order to recognize repeat use of our website by the same user/internet connection subscriber. We declare this explicitly at every visit at the bottom of the screen. Cookies are small text files that your internet browser downloads and stores on your computer. They are used to improve our website and services. In most cases these are so-called “session cookies” that are deleted once you leave our website. To an extent, however, these cookies also pass along information used to automatically recognize you. Recognition occurs through an IP address saved to the cookies. The information thereby obtained is used to improve our services and to expedite your access to the website. You can prevent cookies from being installed by adjusting the settings on your browser software accordingly. You should be aware, however, that by doing so you may not be able to make full use of all the functions of our website.

Use of Youtube components
In order to embed videocontent, we use the services of Youtube. YouTube is hosted by YouTube LLC in 901 Cherry Avenue, San Bruno, CA 94066, USA. YouTube is being substituted by Google Inc. in 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Youtube explicitly complies with new european laws for Data-Privacy since March 2018. For embedding content, Youtube supplies an encrypted link, which we are using exclusively. More information can be found here: policies.google.com/privacy/frameworks

Newsletter
Our website offers you the opportunity to subscribe to our newsletter. The newsletter provides you periodically with information about our services. To receive our newsletter, we require a valid email address. We will review the email address you provide for the purpose of determining whether you are in fact the owner of the email address provided or whether the actual owner of said address is authorized to receive the newsletter. When subscribing to our newsletter, we will store your IP address as well as the date and time you subscribed. This serves to protect us in the event a third party improperly and without your knowledge makes use of your email address to subscribe to our newsletter. We will not collect any other data. The data thereby collected is used solely for the purpose of receiving our newsletter.

For mailing out the newsletter, we are authorizing the service provider ‘CleverReach’. Data needed for this process will be stored on the servers of ‘CleverReach’. For registration, a douple Opt-in authentication is used, which is in compliance with European Data-Privacy policy. You may cancel your subscription to the newsletter at any time. You will find additional details in the email confirming your subscription as well as in each newsletter.

Newsletters we send out via CleverReach allow us to analyse the user patterns of our newsletter recipients. Among other things, in conjunction with this, it is possible how many recipients actually opened the newsletter e-mail and how often which link inside the newsletter has been clicked. With the assistance of a tool called Conversion Tracking, we can also determine whether an action that has been predefined in the newsletter actually occurred after the link was clicked (e.g. purchase of a product on our website).
